ISPE Enrollment & Financial Agreement 2026-2027
1. PROGRAM TERM & SCHEDULEProgram runs approximately nine (9) months from September 8, 2026 through May 28, 2027. Scheduled hours are 2:30 PM to 4:00 PM, Monday through Friday. ISPE reserves the right to modify schedule as reasonably necessary.
2. TUITION & FEESTotal Program Tuition: $4,300Non-Refundable Enrollment Deposit: $430 (due upon enrollment)Remaining Balance: $3,870One-Time Registration Fee: $300 (includes dri-fit shirts and hats.)
The Registration Fee is non-refundable and required to secure enrollment and cover program-issued apparel and onboarding materials.
All fees outlined herein are earned upon enrollment and are not contingent upon attendance, participation, withdrawal, or completion of the program.
3. PAYMENT TERMSPayments are due monthly on the 1st. Payments received after the 5th are subject to a $50 late fee. Failure to pay may result in immediate suspension or termination of services without refund.
4. NO CANCELLATION / NO WITHDRAWAL POLICY (INITIAL REQUIRED)Enrollment constitutes a legally binding full-term commitment. Parent/Guardian acknowledges that no refunds, cancellations, credits, or early withdrawals shall be granted under any circumstances.

6. FINANCIAL RESPONSIBILITYParent/Guardian assumes full financial responsibility for all amounts due under this Agreement, regardless of attendance, participation, withdrawal, dismissal, or external circumstances.
7. LATE FEES & COLLECTIONSA $50 late fee shall be applied to any overdue payment. Parent/Guardian agrees to pay all costs of collection, including reasonable attorney's fees, court costs, and collections agency fees.
8. CHARGEBACKS & RETURNED PAYMENTSAny charge-back or returned payment shall constitute a material breach of this Agreement and may result in immediate termination and additional fees.
9. ARBITRATION & JURY WAIVER (INITIAL REQUIRED)All disputes shall be resolved exclusively through binding arbitration in the State of California. Parent/Guardian knowingly waives any right to jury trial.
10. CLASS ACTION WAIVERAll claims must be brought individually. Parent/Guardian waives any right to participate in class or representative actions.
11. PERSONAL GUARANTY (INITIAL REQUIRED)Parent/Guardian personally guarantees full and timely payment of all obligations under this Agreement.
12. NO GUARANTEE OF RESULTSAcademy makes no guarantees regarding athletic, academic, or developmental outcomes.
13. FORCE MAJEUREAcademy shall not be liable for delays or interruptions caused by events beyond its reasonable control; however, financial obligations shall remain in full force.
14. ELECTRONIC AGREEMENTElectronic signatures and records shall have the same legal force and effect as original signatures.
15. NON-DISPARAGEMENTParent/Guardian agrees not to make false, misleading, or defamatory statements regarding the Academy.
16. GOVERNING LAWThis Agreement shall be governed by and construed in accordance with the laws of the State of California.
17. SEVERABILITYIf any provision is deemed invalid, all remaining provisions shall remain enforceable.
18. ENTIRE AGREEMENTThis document constitutes the entire agreement and supersedes all prior agreements or understandings.
19. SURVIVALAll provisions relating to payment, dispute resolution, and liability shall survive termination of this Agreement.
20. DEFAULT & ACCELERATIONIn the event of any missed payment, returned payment, or breach of this Agreement, the entire remaining balance shall, at the option of the Academy, become immediately due and payable in full (“Acceleration”).
Academy reserves the right to suspend or terminate participation immediately upon default without relieving Parent/Guardian of financial obligations.
21. APPAREL & EQUIPMENT ACKNOWLEDGMENTParent/Guardian acknowledges that program-issued apparel and gear (including drifits, hats, and any other issued items) are ordered, allocated, and/or customized upon enrollment.
All apparel and equipment fees are final, non-refundable, and non-transferable regardless of participation, withdrawal, or dismissal.
22. ASSUMPTION OF RISK & LIABILITY WAIVER (INITIAL REQUIRED) Participation in athletic training and activities involves inherent risks, including but not limited to injury, illness, or physical harm.
Parent/Guardian voluntarily assumes all risks associated with participation and agrees that Hit Factory Academy, its owners, coaches, employees, and affiliates shall not be liable for any injury, loss, or damage arising from participation, except in cases of gross negligence or willful misconduct.
Parent/Guardian agrees to release, indemnify, and hold harmless the Academy from any and all claims.
23. INDEMNIFICATIONParent/Guardian agrees to indemnify, defend, and hold harmless Hit Factory Academy from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from:
24. AUTHORIZED PAYMENT & RECURRING CHARGESParent/Guardian authorizes Academy to charge the payment method on file for all amounts due under this Agreement, including tuition, fees, late charges, and any outstanding balances.
This authorization shall remain in effect until all obligations are satisfied in full.
ACKNOWLEDGMENT & AGREEMENTBy signing below, Parent/Guardian acknowledges that they have carefully read, fully understand, and voluntarily agree to all terms and conditions contained in this Agreement.
